Requirements
To qualify for this visa, you must meet strict legal definitions of a refugee or satisfy "complementary protection" criteria. You must also meet specific entry and character requirements.
1. Protection Grounds
You must demonstrate that you fall into one of two categories:
- Refugee Status: You have a "well-founded fear of persecution" based on your race, religion, nationality, political opinion, or membership in a particular social group.
- Complementary Protection: You do not meet the technical definition of a refugee, but there is a "real risk" you will suffer "significant harm" if returned. This includes the death penalty, torture, or cruel, inhuman, or degrading treatment.
2. Lawful Arrival and Presence
- Physical Presence: You must be in Australia when you apply and when the visa is granted.
- Valid Entry: You must have entered Australia on a valid visa and been cleared by immigration. If you arrived as an "unauthorised maritime arrival" (by boat without a visa), you are generally barred from this subclass.
- No Safe Third Country: You generally cannot apply if you have a right to reside in a "safe third country" (for example, if you hold dual citizenship with a country where you are not at risk).
3. Disqualifiers
You are ineligible for the Subclass 866 if:
- You currently hold, or have ever held, a Temporary Protection Visa (Subclass 785) or a Safe Haven Enterprise Visa (Subclass 790).
- You have been refused a protection visa since your last arrival in Australia (unless a specific "bar" has been lifted by the Minister).
- You fail the Character and Security assessments, which include checks by the Australian Security Intelligence Organisation (ASIO).
Conditions & Warnings
Must have arrived in Australia on a valid visa and been immigration cleared to apply for this subclass.
Applying immediately after arrival on a visitor visa triggers high scrutiny regarding 'Genuine Temporary Entrant' intentions.
Travel back to the country from which protection was sought will likely lead to visa cancellation.
Holders of Subclass 785 or 790 visas are generally barred from applying for this specific subclass.
Qualifications
No formal language requirement for the visa grant.

Base application fee is AUD 45-50; excludes health checks and biometrics.
