Requirements
To qualify for citizenship by descent, you must meet specific criteria regarding your birth and your parent’s citizenship status.
The "Otherwise Than by Descent" Rule
The most critical requirement is that at least one of your parents must have been a New Zealand citizen otherwise than by descent at the moment you were born. A parent meets this definition if they acquired their citizenship through:
- Birth in New Zealand, the Cook Islands, Niue, or Tokelau.
- Grant (naturalization) after moving to New Zealand.
- Adoption by a New Zealand citizen (in specific legal circumstances).
The One-Generation Limit
New Zealand law generally limits the transmission of citizenship to one generation born abroad.
- If your parent is a New Zealand citizen by descent (meaning they were also born outside of New Zealand and claimed citizenship through their own parent), they typically cannot pass citizenship to you.
- Exceptions: You may still qualify if your parent was abroad in "Crown Service" (such as military, diplomatic, or police posting) at the time of your birth, or if you would otherwise be left stateless.
Nationality-Specific Variations
- Samoan Ancestry: Under the Citizenship (Western Samoa) (Restoration) Amendment Act 2024, specific pathways exist for Samoan citizens whose New Zealand citizenship was previously removed. If you have ancestors born in Samoa before 1949, you may have unique grounds for a claim.
- Māori Whakapapa: While the Waitangi Tribunal recently recommended extending citizenship to two generations for Māori to honor whakapapa (genealogy), the government has not yet amended the law. Currently, the one-generation limit applies to all applicants regardless of ethnicity.
Conditions & Warnings
New Zealand strictly enforces a one-generation limit; citizens 'by descent' cannot typically pass citizenship to children born outside New Zealand.
The Waitangi Tribunal recently found the one-generation limit breaches treaty principles for Māori, but the government has currently rejected changing the law.
